1.2. The seller reserves the right to change, amend or supplement the Rules at any time. 1.3. Active natural persons have the right to buy in our online store; minors between the ages of fourteen and eighteen, only with the consent of their parents or guardians, except in cases where they dispose of their income independently; legal entities.

2. Entry into force of the purchase-sale agreement
2.1. The contract - a completed purchase between the Buyer and the Seller is considered to be concluded from the moment when the Buyer, after selecting the item(s) to be purchased and creating a shopping cart, clicks on the "CHECKOUT" link.
2.2. WWW.KINDERIS.LT is not obliged to separately notify the Buyer of its consent to enter into a contract. It is considered that WWW.KINDERIS.LT confirms the order from the moment it starts executing it.
2.3. Every purchase and sale agreement concluded between the Buyer and the Seller (completed purchase with a purchase document) is registered and stored in the database of the WWW.KINDERIS.LT online store.

3. Buyer's rights
3.1. The buyer has the right to purchase goods in the WWW.KINDERIS.LT online store in accordance with the procedure established by these Rules and the online store.
3.2. The buyer has the right to refuse the contract of purchase and sale of goods
(completed purchase with purchase document ) concluded with the WWW.KINDERIS.LT online store by notifying the Seller in writing (by e-mail, indicating the order number) no later than within 14 (fourteen) days, the term begins to count , when all order shipments are delivered to the Buyer, or the Buyer collects the goods and returns the item(s) purchased in accordance with the concluded contract in accordance with the procedure provided for in Clause 4.6 of the Rules.
3.3. The buyer cannot return the goods in the following cases:
3.3.1. if the goods are returned, which were manufactured taking into account the personal needs of the Buyer or according to the conditions provided by the Buyer;
3.3.2. in other cases, when the purchase-sale contract cannot be refused, according to the laws of the Republic of Lithuania.

3.4. The Buyer can use the right to return goods only if the product has not been damaged, the packaging has not been damaged or its appearance has not fundamentally changed, and it has not been used. 3.3 of the rules. The Buyer's right provided for in point is implemented in accordance with the Government of the Republic of Lithuania 2014 July 22 by resolution no. 738 "On the Government of the Republic of Lithuania in 2001 June 11 resolution no. 697 "Regarding the approval of retail trade rules" amendment and the procedure established in Articles 6.22810 and 6.22811 of the Civil Code.
3.5. A request/complaint regarding goods purchased in an electronic store can be submitted to the State Consumer Rights Protection Service
4. Obligations of the buyer
4.1. The buyer must accept the goods according to the procedure established by these Rules and pay the agreed amount for them.
4.2. If the data provided in the Buyer's registration form changes, he must update it immediately.
4.3. The buyer, using the WWW.KINDERIS.LT online store, undertakes to comply with these Rules and not to violate the laws of the Republic of Lithuania.
4.5. If the Buyer, during the delivery of the goods, takes possession of the goods without good reason, the Buyer must cover the costs of the delivery of the goods.
4.6. If the Buyer decides to refuse the goods of suitable quality, he must send or deliver the goods to the Seller immediately and no later than within 16 (sixteen) days from the date of submitting the notice of withdrawal to the Seller. In this case, all shipping and delivery costs are borne by the Buyer.


5. Seller's Rights

5.1. In the event of important circumstances, the Seller may temporarily or completely stop the operation of the online store without notifying the Buyer in advance.
5.2. The Seller has the right to cancel the order without notifying the Buyer in advance, if the Buyer, having chosen non-cash payment methods, does not pay for the goods within 2 (two) working days.

5.3. When the Buyer chooses the payment method provided for the delivery of the goods in cash, the Seller, in the event of uncertainty regarding the information submitted in the order, contacts the Buyer on the phone specified in the order. The Seller has the right to cancel the order without prior notice to the Buyer if the Seller fails to contact the Buyer within 2 (two) working days.
5.4.WWW.KINDERIS.LT has the right in all cases not to conclude a Purchase and Sale Agreement with a specific Buyer who placed an order, including, but not limited to, cases where the Buyer refused the Purchase and Sale Agreement and returned the goods 2 or more times in the last 9 months.
5.6. WWW.KINDERIS.LT has the right to refuse the concluded Purchase and Sale Agreement if the stock of the goods specified in the agreement has run out, as well as if the agreement was concluded by a person who, based on these Rules, did not have the right to conclude the agreement.

6. Obligations of the seller
6.1. The Seller undertakes to provide the Buyer with the opportunity to use the services provided by the WWW.KINDERIS.LT online store under the conditions set out in these Rules and the online store.
6.2. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by him and under the conditions specified in these Rules.
6.3. The Seller, unable to deliver the ordered goods to the Buyer due to important circumstances, undertakes to offer an analogous or similar product as far as possible. If the Buyer refuses to accept an analogous or the most similar product, or if the Seller does not have an alternative offer, the Seller undertakes to return the money paid to the Buyer within 3 (three) working days, if prepayment was made.
6.4. The Seller undertakes to respect the Buyer's privacy right to his personal information, specified in the online store registration form, except for the cases established by the laws of the Republic of Lithuania.
 
7. Product prices, payment procedure and terms
7.1. The prices of goods in the online store and in the created order are shown in euros with VAT. WWW.KINDERIS.LT reserves the right to change the prices of goods in case of changes in tax rates, as well as in cases where the manufacturer/supplier changes the pricing of goods.
7.2. The buyer pays for the goods in one of the following ways:
7.2.1. Payment by bank transfer is an advance payment when the Buyer, after printing the order and going to the nearest bank branch or simply using the online banking system, transfers the money to one of WWW.KINDERIS.LT's bank accounts.
7.2.2. Payment by entering bank card data (VISA, MASTERCARD, MAESTRO) or by using the banklink service is an advance payment, when the Buyer, using the online banking system, transfers money to the KINDERIS.LT bank account .
7.2.3. Payment in cash at the time of delivery of the goods - the Buyer pays for the goods at the time of their delivery (handover - acceptance).
7.3. When paying by the payment method provided in point 7.2.1, the Buyer undertakes to pay immediately. In the aforementioned cases, only after receiving the payment for the goods, the preparation of the goods parcel begins and the calculation of the goods delivery term begins.

7.4 If the payment (except cash payment at the time of goods delivery) is received on a working day before 11 a.m., this day is counted as the first day of order execution. If payment is received after 11 a.m. (including weekends or holidays), then the first day of order fulfillment and product delivery is the next working day.

8. Delivery of goods
8.1. The goods are delivered by the Seller or his authorized representative.

8.2. The seller undertakes to deliver the goods to the buyer in accordance with the terms specified in the product description. These terms do not apply in cases where the necessary goods are not available in the Seller's warehouse, and the Buyer is informed about the shortage of the goods ordered by him. At the same time, the Buyer agrees that in exceptional cases the delivery of goods may be delayed due to Force Majeure circumstances.

8.3. The price of delivery of the goods to the Buyer is specified before making the payment. The price of delivery of the goods is paid in advance, together with the payment for the goods.

8.4. Products are delivered to Buyers in Lithuania and Latvia within 1-3 working days after order confirmation. Delivery to other EU countries lasts from 7-14 days. The buyer is informed by e-mail about the exact date and time interval of the delivery of the goods. by mail and/or phone. The buyer can be individually informed about a different delivery time of the goods. The Seller does not guarantee that the goods will be delivered in all cases within the delivery terms specified in the Rules and/or elsewhere in the Store, as well as those specified individually for the Buyer, especially if the ordered goods are not in the Seller's warehouses. The seller undertakes to make every effort to deliver the product as soon as possible.
8.5. When ordering the goods, the buyer undertakes to indicate the exact place of delivery of the goods.
8.6. The buyer undertakes to accept the goods himself. In the event that he cannot accept the goods himself, and the goods are delivered to the specified address and based on other data provided by the Buyer, the Buyer has no right to make claims to the Seller regarding the delivery of the goods to the wrong entity.
8.7. During the delivery of the goods, the Buyer must check the condition of the shipment together with the Seller or his authorized representative. After the buyer has signed the invoice (bill of lading) or other shipment transfer-acceptance document, it is considered that the shipment has been delivered in proper condition.
8.8. In the event that the Buyer, based on these Rules, refuses the purchase-sale agreement, he is obliged to pay all the direct costs of returning the goods to the Seller. The amount of these costs of the Seller is deducted from the amount of money paid for the goods to be returned to the Buyer.
8.9. If it is not possible to deliver the ordered goods in one shipment, WWW.KINDERIS.LT has the right to deliver the goods in several shipments.
8.10. If the purchase and sale contract provides for the transportation of items and the Seller sends the items to the Buyer, the risk of accidental loss or damage of the items passes to the Buyer when he or a person designated by him, other than the carrier, receives the items. If the items are handed over to the carrier chosen by the Buyer, and the Seller did not offer such delivery, the risk provided for in this section passes to the Buyer when the items are handed over to the carrier.

9. Product quality guarantee and expiration date
9.1. All goods are subject to the manufacturer's warranty terms. If the product breaks down during the warranty period, the repair is carried out free of charge (unless there are circumstances that eliminate the Seller's responsibility provided by legislation).

9.2. The characteristics of each product sold on WWW.KINDERIS.LT are generally indicated in the product description attached to each product.
9.3. The seller is not responsible for the fact that the color, shape or other parameters of the goods in the online store may not correspond to the real size, shape and color of the goods due to the characteristics of the display used by the Buyer.
9.4. In the event that the Seller does not provide a quality guarantee for certain types of goods, the guarantee provided by the relevant legal acts shall apply.
9.5. The quality guarantee provided by the seller does not limit or constrain the rights of the Buyer, which are established by law in the event of the purchase of goods or services of inappropriate quality.

10. Return and exchange of goods

10.1. The return and exchange of goods is carried out in accordance with 2014 of the Government of the Republic of Lithuania. July 22 by resolution no. 738 "On the Government of the Republic of Lithuania of 2001 June 11 resolution no. 697 "Regarding the approval of retail trade rules" amendment and the procedure established in Articles 6.22810 and 6.22811 of the Civil Code.
10.2. The Buyer can exercise the right to return and exchange the goods within 14 (fourteen) days from the day of collection or delivery of the goods (the term starts to be calculated when all the order parcels are delivered to the Buyer), by informing the Seller about it in the manner provided for in Clause 3.2 of the Rules.
10.3. The returned product must be in the original, neat packaging, damaged by the Buyer, without losing the appearance of the product (intact label, untorn protective film, etc. (this clause does not apply in the case of returning a low-quality product), in the same set as the Buyer received, with the necessary presentation of the product purchase document and warranty coupon (if it was issued).
10.4. The Buyer can deliver the returned goods to the address specified by the seller himself or send them using courier services. In case the product is returned based on 3.2. the right provided for in paragraph 1, the Buyer shall bear the costs of returning the goods. When the wrong goods and/or low-quality goods are returned, the Seller undertakes to take such goods and replace them with similar suitable goods. In case the Seller does not have similar goods, he returns the money paid for the goods to the Buyer.
10.5. The Seller has the right not to accept the goods returned by the Buyer if the Buyer does not comply with the procedure for returning the goods established in this article.

11. Liability
11.1. The buyer is fully responsible for the correctness of the data provided in the purchase form. If the Buyer does not provide accurate data in the purchase form, the Seller is not responsible for the resulting consequences.
11.2. The buyer is responsible for the actions performed using this online store.
11.3. The Seller is released from any responsibility in cases where losses arise because the Buyer, disregarding the Seller's recommendations and his obligations, did not familiarize himself with these Rules, although he was given such an opportunity.
11.4. If the Seller's online store contains links to the websites of other companies, institutions, organizations or individuals, the Seller is not responsible for the information or activities carried out, does not supervise or control those websites and does not represent those companies and individuals.
11.5. In the event of damage, the guilty party compensates the other party for the direct losses incurred.

12. Exchange of information
12.1. The seller sends all notifications to the e-mail address provided in the Buyer's registration form or via SMS.
12.2. The buyer sends all messages and questions using the means of communication specified in the "Contacts" section of the Seller's online store.

13. Protection of personal data
13.1. The personal data processing and protection rules provided for in point 13 apply to all personal data that the Buyer provides to the Seller or that the Seller collects and processes for the Buyer using the WWW.KINDERIS.LT website.
13.2. The Seller respects the privacy of the Buyer and other WWW.KINDERIS.LT website visitors and protects their personal data, which is provided to the Seller and which the Seller collects, as specified in these Rules, which explain why the Seller collects personal data and how it is used.
13.3. The buyer, who wants to order goods in the WWW.KINDERIS.LT online store, can buy without registration.

13.4. On the WWW.KINDERIS.LT website, the buyer provides the following personal data necessary to fulfill the order: name, surname, phone number, e-mail mailing address, address, recipient (delivery) address.
13.5. The seller confirms that these personal data will be used for the purpose of selling goods in the WWW.KINDERIS.LT online store and for the purpose of delivering goods. The legal basis for the processing of this data is the conclusion and execution of the contract of sale of goods.
13.6. The Buyer confirms that he is aware of his right to refuse to provide his personal data, but understands that these personal data are necessary and necessary for the fulfillment of the order for goods, and if the Buyer does not provide such data and does not consent to their processing in accordance with 13.6 of these Rules. point, the Agreement for the purchase and sale of goods will not be able to be concluded and executed.
13.7. In order to receive direct marketing offers, the buyer must specify his e-mail address. e-mail address and telephone number in the registration form or when ordering goods. These personal data will be used for direct marketing purposes only if the Buyer gives his consent by ticking the optional direct marketing sending method (e-mail and/or SMS. These data will also be processed for direct marketing purposes.
13.9. The buyer has the right to withdraw his consent to the use of personal data for direct marketing and administration purposes at any time by contacting the Seller at info@kinderis.lt or by registered mail at REBUSA UAB (WWW.KINDERIS.LT), Liepų st. 10, Kariotiškiu km., Lentvarios sen., Trakai district. LT25100.

13.10. The Seller stores all data of the Buyer and other visitors to the WWW.KINDERIS.LT website no longer than is necessary for the purposes specified in these Rules.
13.11. The buyer's data are stored and used for the purpose of selling goods in the WWW.KINDERIS.LT online store for 10 years after the conclusion of the purchase and sale agreement.

13.12. The data of the Buyer and other visitors to the WWW.KINDERIS.LT website are stored and used for direct marketing and administration purposes for 3 years after the last purchase on the WWW.KINDERIS.LT website, or shorter if a request is received from the Buyer or other visitors to the WWW.KINDERIS.LT website to refuse to receive direct marketing messages.
13.13. The Seller undertakes not to disclose personal data to third parties, with the exception of the Seller's partners who provide goods delivery, the Seller's website or databases, equipment administration, or other services related to the proper fulfillment of the Buyer's order and the sending of direct marketing offers. In all other cases, any of the Buyer's personal data can be disclosed to third parties only in accordance with the procedure provided by the legislation of the Republic of Lithuania.
13.14. The seller applies the security and processing requirements for data processing, established in the Law on Legal Protection of Personal Data of the Republic of Lithuania and the General Data Protection Regulation of the European Union.
13.15. The seller takes appropriate technical and organizational measures to ensure the protection of all processed personal data against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access, and against all other forms of unlawful processing.
13.16. The buyer has the following rights in relation to personal data:

13.16.1. request that the Seller allows access to the data and deletes it or restricts data processing;
13.16.2. the right to object to data processing;
13.16.3. the right to receive your personal data in a structured, commonly used and computer-readable format (right to data portability);
13.16.4. the right to withdraw consent;
13.16.5. the right to submit a complaint to the State Data Protection Inspectorate.

14. Final provisions
14.1. Relations arising on the basis of these rules shall be governed by the law of the Republic of Lithuania.
14.2. All disagreements arising from the implementation of these rules shall be resolved by negotiation. If an agreement cannot be reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
